What Do Both Parties Agree To Do?

As our client, you are entering into this agreement on behalf of your company or organization. You agree to provide the necessary materials, such as text, images, and information, in the format requested by us and in a timely manner. You will also review our work and give feedback promptly. Deadlines work both ways, and you agree to adhere to any timelines we set together. You’ll also stick to the payment schedule as agreed.

Kondlo Designs has the skills and expertise to deliver the services required and will carry them out professionally and within the timelines set. However, we cannot be held responsible for missed deadlines if delays occur due to late supply of materials or untimely approval of our work. Confidentiality will always be maintained regarding the information provided.

Design

For design services, we will create designs for the layout, look, and functionality. This contract covers one primary design with up to two rounds of revisions unless stated otherwise. If you are dissatisfied at this stage, you will pay for the work completed to date, and you may either cancel the contract or continue with additional revisions at our standard design rate.

HTML and CSS Layout Templates

If the project includes HTML and CSS templates, we will ensure valid code compatible with current versions of major desktop browsers. We will also test the templates on devices such as iPads. Please note that we do not support outdated browsers like Microsoft Internet Explorer 6, and additional charges may apply if testing for older versions is required.

Text Content

We are not responsible for writing or inputting text unless otherwise specified in the estimate. If you require content creation, we will provide it at an additional charge.

Photographs

You will provide all photographs in digital format. If stock photos are required, we can suggest vendors, and any time spent sourcing images will be charged at our standard rate.

Changes and Revisions

We understand that your vision may evolve, and we welcome changes. If you decide to add extra features, pages, or functionality, additional charges will apply. Any change that impacts the scope of work will also affect the timeline. If the project significantly changes during development, we reserve the right to consider the project canceled, and you will pay for the work completed up to that point.

Technical Support

If you do not have a hosting solution or need assistance setting up hosting, we can arrange it for you with our partnered hosting provider. A one-time installation fee and annual hosting charges will apply. These are non-refundable.

Legal Stuff

We cannot guarantee that the functions on the website will always be error-free, and we are not liable for any incidental, consequential, or special damages, including loss of profits or savings.

If any part of this agreement is deemed unenforceable, the remaining parts will still be valid.

Copyrights

You guarantee that any text, graphics, photos, designs, or trademarks you provide are either owned by you or that you have permission to use them. Upon receiving final payment, ownership of the graphics and other visual elements created for this project will transfer to you, though we retain the right to display the work in our portfolio. We will provide you with all files at the completion of the project.

Payments

We expect prompt payment of invoices. If you delay providing content or feedback, the final invoice will be issued once the site is ready to go live. If the final invoice is not paid within the agreed credit terms, we reserve the right to withhold access to the site and discontinue work on the project.

This contract cannot be transferred without our consent. If any part of this agreement becomes unenforceable, the remaining terms will remain in effect.

Refund Policy

As digital products are non-returnable, refunds are only available under the following circumstances:

1. Duplicate purchases.
2. Unresolved technical issues after providing sufficient details.
3. Misrepresentation of the product (e.g., functionality does not match the description).

Refunds will not be given if:

• The product is no longer needed or if you’ve changed your mind.
• You lack the expertise or software required to use the product.
• You cannot download the product due to internet-related issues.
